Accessible Parking Maintenance in Winter: Compliance and Best Practices

Ontario's accessibility standards require accessible parking spaces and routes to remain functional throughout winter — understanding the specific requirements prevents compliance failures.

The Ontario Human Rights Code and the Accessibility for Ontarians with Disabilities Act (AODA) both create obligations for property owners to maintain accessible parking and routes year-round. In winter, this means accessible spaces must be cleared at the same priority level as main traffic lanes — not after, but simultaneously.

Winter Preparedness Tips

Width of accessible spaces after snow clearing matters. A standard accessible space is 2.4 metres wide, with an adjacent access aisle of equal width. If snow is piled against the edge of the accessible space, reducing the effective width below the minimum, the space is not accessible even if the surface is clear.

The route from the accessible parking space to the accessible building entrance must be cleared and maintained. A cleared parking space is functionally useless if the pathway to the door isn't maintained. Inspect the full route — across the parking lot, through any curb cuts, along the walkway to the accessible entrance — after each service visit.

Snow accumulation on signage poles, or snow piled in front of signs, obscures the legal designation and the accessible space may be used by non-accessible vehicles, leaving it unavailable when needed.
